IFA’s Franchise Action Network Disappointed by Congress’ Decision Not to Include Small Business Fix from Omnibus Package

Despite an unprecedented grassroots, public affairs, media and lobbying campaign this year from the Franchise Action Network and Coalition to Save Local Businesses broad membership, the joint employer fix to return to the traditional definition of employer was not included in the final omnibus spending package this week.

"Democrat or Republican, it is not Washington’s role to make business decisions for me. Policymakers should focus on ways to help create an environment that allows small businesses, which create two-thirds of all net-new jobs, to thrive — spreading opportunities for people across this country and adding to our economy. The NLRB’s ruling in Browning-Ferris does the opposite. It threatens small businesses and shows inadequate understanding of the function of the American workplace in a modern economy." said Heather Pitsiladis, MODE co-owner, North Dakota & FAN, just weeks ago before finding out that the appropriations rider would not be included in the Omnibus package.

IFA received tremendous support and engagement from the Franchise Action Network which allowed the previously-unknown joint employer issue to gain enough support to make the short list for inclusion in the spending package as well as leading the introduction of an authorizing bill, the Protecting Local Business Opportunity Act, with 160 bipartisan cosponsors.

FAN support was crucial in generating much-needed attention to this issue. FANs sent over 9,500 joint employer letters to Congress and participated in more than 300 meetings and local roundtables with members of Congress in Washington, DC and in the states.

Unfortunately, the small business community’s concerns fell short of the omnibus package or passage of the Protecting Local Business Opportunity Act.

IFA’s President and CEO Robert Cresanti stated: “Trial lawyers deliver a collective cheer, as Congress has served up another lump of coal to all small business owners in every congressional district, fully ignoring the tens of thousands of their requests to include this language in the omnibus. Lawmakers will assuredly be hearing about their failure to undo this corrosive and damaging NLRB decision.”

However, moving into the New Year, IFA and the Coalition to Save Local Businesses will look to continue spearheading this paramount issue to the small business community, remaining the leading voice on the joint employer issue and will continue pressuring Congress to restore certainty to the franchise community.

Cresanti went on to say, “We appreciate the support of hundreds of lawmakers in both parties for protecting local businesses from the NLRB’s overreach and are hopeful when Congress returns next year, they will be awakened to the impact this decision is causing for families in communities across America and be motivated to act.”
