Task Force Listening Session on Labor & Workforce Regulations

On Thursday, May 5, 2016, IFA’s Vice President of Regulatory Affairs, Michael Layman was invited to speak before the Reducing Regulatory Burdens Task Force, a joint effort of the House Small Business Committee and the Education and Workforce Committee. Mr. Layman presented comments as part of a four-member panel to address small business industry concerns on overregulation and harmful policies impacting a broad spectrum of independent business owners. Joining Mr. Layman on the panel, the task force welcomed Ms. Elizabeth Milito of the NFIB Small Business Legal Center, Ms. Kelly Hastings of the Society for Human Resource Management, and Ms. Suzanne Beall of the National Association of Home Builders.

Topics covered at the listening session ranged from burdensome reporting requirements for employers, to restrictions on retaining legal counsel in situations of union encroachment in the workplace. Mr. Layman focused his segment on the National Labor Relations Board’s (NLRB) rule on joint employment and its consequences for the franchising model.

“Joint employer threatens to turn the individually operated franchises of the nation – locally owned small businesses – into corporate run behemoths operated by staff. Business ownership disappears, and Main Street is taken over by big corporations.”

Mr. Layman made a point to note that franchising in America is made up of more than 800,000 independent stores employing 9.1 million people and accounts for three percent of the national Gross Domestic Product. He made clear that this risk threatens the long-term viability of thousands of franchise businesses due to the inevitable increase in joint employer claims filed against both a franchisor and franchisee for alleged employment violations. Further, Mr. Layman warned that joint employment opens up the door for labor unions to transform the workforce and the small business landscape.

Those attending the session included Congressional staffers and trade association executives dedicated to socializing these issues and promoting sensible, realistic solutions to combat overregulation.
